第五條房屋產權及具體狀況的承諾

(二)出賣人確認。該房屋在其本人或其近親屬持有期間。在房屋本體結構內是否發生過非正常死亡事件(包括但不限于自殺、他殺、從該房屋內墜出死亡、意外死亡等)。如果出賣人在簽署本合同前就前述事項隱瞞真實情況的。三方確認:因出賣人之欺詐行為。使得買受人和居間方在違背真實意思的基礎上訂立本合同。買受人有權依法要求撤銷房屋買賣合同及相關協議。出賣人另應承擔如下責任:
1、出賣人應當在買受人提出請求后十個工作日內返還買受人全部房款;未如期返還的。出賣人應當按日計算向買受人支付房屋成交總價萬分之五的滯納金。
Article V Housing property rights and Specific Conditions of Commitment
(I) The Seller shall ensure that the house has not any property rights disputes and limited to transfer. In case that house has not been gone through the property right registration or debts dispute has been taken place caused by any one party violates the previous commitment, the delinquent party shall pay 20% of the total price of the house to the other party as compensation. This Clause is an independent clause, even though the Contract and other attached documents shall be changed, revoked, cancelled, terminated or deemed to be null and void according to law as either party violates the aforementioned commitments, the stipulations in this Clause shall still be valid, and the non-breaching party may investigate for the legal responsibility of the breaching party according to the provisions of this Clause.
(II) The Buyer confirm whether it has happened any wrongful death incidents ( including but not limited to suicide, homicide, death of falling out from the house, accidental death, etc.) in the body structure of the house during the holding period of the Buyer or its close relatives. If the Buyer conceals the true situation of the aforesaid matters before signing the Contract, three parties shall confirm that the Buyer has the right to ask for termination of the Contract and the relevant agreements, in case that the Buyer and the Broker sign the Contract against their genuine will due to fraudulent conduct of the Seller. The Seller shall undertake the following responsibilities:
1. The Seller shall return the total amount of the house to the Buyer within 10 working days after the date when the Buyer submits a request; In case of making payment overdue, the Seller shall pay a late fee of 0.005% on overdue total amount in a daily basis to the Buyer.
